Terms of Service

These Terms of Service ("Terms") govern your access to and use of Foghlai ("we", "our", or "the app"). By using Foghlai, you agree to these Terms. If you do not agree, please do not use the service.

Foghlai is an AI-assisted language exam practice application. It currently provides IELTS-focused speaking, listening, reading, writing, mock exam, AI feedback, pronunciation assessment, transcription, and mistake review features.

Foghlai is an independent learning tool. It is not affiliated with, endorsed by, or sponsored by IELTS, the British Council, IDP, Cambridge, or any official test provider.

Foghlai may provide AI-generated scores, comments, transcripts, pronunciation analysis, writing feedback, and study suggestions.

These outputs are provided for practice and self-review only. They are not official IELTS scores, professional educational advice, immigration advice, or a guarantee of any exam result.

AI and speech processing may be inaccurate, incomplete, delayed, or unavailable. You are responsible for reviewing the output and deciding how to use it.

You are responsible for maintaining the security of your account and login credentials. You must provide accurate information when creating or updating your account.

You may not share your account with others, sell access to your account, or create multiple accounts to bypass usage limits or access restrictions.

We may suspend or restrict access if we reasonably believe an account is being misused, used unlawfully, or used in a way that may harm the service or other users.

Foghlai is currently an early-stage, invite-only product. Access may be limited, changed, suspended, or discontinued at any time.

We may modify features, impose usage limits, restrict access to certain functions, or change the availability of the service as the product develops.

We aim to keep the service reliable, but we do not guarantee uninterrupted access, error-free operation, or permanent availability of any feature.

You may submit content such as recordings, transcripts, writing drafts, answers, profile settings, and practice results ("User Content").

You retain ownership of your User Content. By submitting User Content to Foghlai, you grant us limited permission to process, store, transmit, analyze, and display that content only as needed to provide, maintain, secure, and improve the service.

You are responsible for the content you submit. You must not submit content that is illegal, harmful, infringing, deceptive, or that violates another person's privacy or rights.

Foghlai relies on third-party services for hosting, authentication, storage, email delivery, speech processing, AI feedback, transcription, and related infrastructure.

Some features may require sending User Content or technical information to these providers as described in our Privacy Policy.

We are not responsible for interruptions, errors, limitations, policy changes, or other issues caused by third-party services, although we aim to choose reliable providers and handle failures reasonably.

• Do not use Foghlai for illegal, harmful, abusive, fraudulent, or infringing purposes.
• Do not upload content that violates the rights or privacy of others.
• Do not reverse-engineer, scrape, overload, disrupt, or interfere with the service.
• Do not bypass access controls, rate limits, invite-only restrictions, or security measures.
• Do not use automated tools or bots without permission.
• Do not resell, sublicense, or commercially exploit the service without written authorization.
• Do not copy, redistribute, or publish Foghlai content or interface materials without permission.

Foghlai, including its software, source code, interface design, original content, product name, and branding, is owned by LIU LIJUN or licensed to us. All rights are reserved.

You may use Foghlai only for personal language learning and practice unless we give you written permission for another use.

IELTS is a registered trademark of the British Council, IDP, and Cambridge. Foghlai is an independent study tool and is not affiliated with or endorsed by the official IELTS partners.

You may request deletion of your account and associated data through the app where available or by contacting us.

After deletion, your practice history, feedback, recordings, progress, and account information may no longer be available or recoverable. Some limited records may remain temporarily in backups, logs, provider systems, or where required for security, legal compliance, or abuse prevention.

Foghlai is provided "as is" and "as available" without warranties of any kind.

We do not guarantee that the service will meet your expectations, improve your exam score, be error-free, be available at all times, or produce accurate AI feedback, transcription, pronunciation assessment, or scoring.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of opportunity, exam results, or other outcomes related to your use of the service.

We may update the service or these Terms from time to time. When we make meaningful changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Continued use of Foghlai after changes become effective means you accept the updated Terms.

These Terms are governed by the laws of Japan. Any disputes arising from or relating to the use of Foghlai shall be subject to the exclusive jurisdiction of the courts of Japan.
